Is It Legal To Buy Delta-8?

There are two reasons why delta-8 is legal.

  1. The 2018 Farm bill made industrial hemp and extracts from it legal. Industrial hemp contains no more than 0.3% THC, but it’s still packed with more than 60 cannabinoids and hundreds of other plant chemicals.(2) Delta-8 is one of these compounds, making it legal on the federal level.
  2. Delta-9-THC remains a controlled substance, but tetrahydrocannabinols (THCs) found in industrial hemp are not a controlled substance. aka, They’re legal.

But some states are interpreting the law differently. They argue that, since delta-8 in available D8 products isn’t a direct extract from the hemp plant but is synthesized from a hemp extract, it shouldn’t be considered legal.(3) Federal law says tomato; they say to-maht-no.

As of June 2021, 15 states have banned or imposed restrictions on delta-8-THC.(4) If you live in a state that has D8 restrictions, this can make it more challenging to buy delta-8.

But if you live in a D8-friendly state, you’re in the clear to buy delta-8 products online and at whatever establishments your local government allows.

How To Buy Delta-8-THC

Buying D8 isn’t so different from buying CBD oil. The process might involve a little more research your first time around. Once you hone in on your favorite product, it’s smooth sailing.

Where Is D8 Available?
